Before: ENGEL, KEITH and MERRITT, Circuit Judges Order This appeal has been referred to a panel of the court pursuant to Rule 9(a), Rules of the Sixth Circuit. After examination of the record, this panel agrees unanimously that oral argument is not needed. Rule 34(a), Federal Rules of Appellate Procedure. Plaintiffs filed a civil rights action which was dismissed by the district court. A motion to set aside the judgment was also overruled. After the time to appeal had expired, plaintiffs moved for an extension of time due to excusable neglect to file a notice of appeal. The district court denied the motion and plaintiffs filed a timely notice of appeal from the order.
